™️ What Is 4D HYPE’s Trademark Policy?

At 4D HYPE, we respect trademarks and expect users to do the same. Trademarks help identify the source of a product or service, and using one the wrong way can get tricky. This guide explains how trademarks work, what’s allowed, and how to report or appeal trademark-related issues.

A trademark is a word, phrase, logo, or design that identifies a trademark owner as the source of a good or service,

Trademark infringement occurs when a brand’s registered trademark is used without permission in a way that; causes confusion about the origin of the goods or services and/or the affiliation with the trademark owner, dilutes the brand’s distinctiveness, or damages its reputation.

Trademarks are territorial, which means that they need to be registered in every country in scope of where they may be used. You can read more about trademarks here and here

✅  What is not a 4D Hype Trademark Policy violation? 

Here are a few examples that are generally not considered to be violations of 4DHype’s Trademark Policy:

  1. 💬 Using a trademark for the purpose of providing reviews, discussion, news reporting, parody, or criticism of the trademark owner’s goods or services
    1. An airline brand has a trademark for their company name. A 4D Hype user writes a review about the brand and its cancellation policy. In their content, they use the trademark to refer to the airline brand and to share a negative experience dealing with the brand’s customer service team.
  2. 🧙 Using a trademark in a manner that is outside the trademark’s scope of protection, for example to sell or promote goods or services in a different territory or a different type of goods or services than the trademark is registered to protect
    1. A company has a registered trademark in the United States for the name of their juice drink. A 4D Hype user happens to use the same name as their UK-based magician name and makes a post promoting the magician services.
  3. 🙅 Using a trademark in a way that has nothing to do with the trademark owner’s goods or services
    1. A clothing brand has a trademark for the name of their most popular clothing line, the “HighNorth.” A Reddit user creates the username “HighNorth1” and posts about TV & films.
  4. 🎮 Using a trademark in a stack name to help people understand the stack’s purpose, such as discussion about the trademark owner’s products or business practices
    1. A company has a trademark for the name of their video game. A 4D Hype user creates a stack named after the video game, where people can join the Orbs page to ask questions about how to beat levels and share their own gaming tips. The Stack makes clear that they are not an official company Stack.

📣 How can copyright owners report Trademark Policy violations to 4D Hype?

To report potential Trademark Policy violations you can, VIA the following ways:-

👤 If you HAVE a 4D Hype account:

  1. Click ‘Make Reportʼ on the post
  2. Select ‘Other issue’ > ‘It infringes my trademark rights’

🚫 If you do NOT HAVE a 4D Hype account:

  1. Go to the ‘Trademark Requestʼ page
  2. Choose ‘Tradement Request’ from the drop-down menu
  3. Provide as much detail as possible, including links to the trademark content

What steps does 4D Hype take in response to a trademark takedown notice?

  • We Review Reports in Order
    • We process trademark takedown notices in the order in which they are received. Once you've submitted the completed form, we will email you the confirmation.
  • We Take Action If Needed
    • If we decide to remove or disable access to the material, we will notify the affected user(s).
  • Your Info May Be Shared
    • Note that because we may provide the trademark owner’s name, your contact information, and the description of the alleged infringement to the affected parties upon request. 
      • ✅ For this reason, you may wish to provide your business mailing address and professional email address in the Contact Information section of your notice.
      • 🙋 If you do not wish for your contact information to be shared with the affected parties, you may authorize a representative to submit the trademark infringement notice on your behalf. 
  • ⚠️In appropriate circumstances, 4D Hype bans user accounts that repeatedly violate 4D Hype’s Trademark Policy. 

❌ What can I do if content I posted to 4D Hype was removed in response to a trademark takedown notice?

We will notify you if we remove your content for violating 4D Hype’s Trademark Policy. If you believe that your content does not violate this policy or was otherwise removed in error, you may submit an appeal within six months of receiving the content removal message. 

To submit an appeal, follow the instructions in the message you received about the violating content or submit a Trademark Counter Notice VIA

  1. Click ‘Make Reportʼ on the post
  2. Select ‘Other issue’ > ‘Tell us about another issue’
  3. Choose ‘Copyright Counter Notice’ from the drop-down menu 

If you do NOT HAVE a 4D Hype account:

  1. Go to the ‘Trademark Counter Noticeʼ page
  2. Choose ‘Trademark Counter Notice’ from the drop-down menu
  3. Provide as much detail as possible, including links to the material prior to its removal (note: the description from the copyright notice will suffice);

⚖️ Important Legal Info

⚠️ A counter notice is a request for 4D Hype to reinstate the removed material, and is the start of a legal process that has legal consequences. 

💡 Alternatively, you may be able to seek a retraction of the copyright complaint from the reporter.
